Terms and Conditions

The auction is organised by GN Damian Marciniak (Gabinet Numizmatyczny Damian Marciniak / Numismatic Cabinet Damian Marciniak), Al. Jerozolimskie 65/79, 00-697 Warsaw, Poland. EU Taxpayer Identification Number PL8311479658.
The auction is conducted to order and for the account of the owners of items, who remain anonymous, and on the behalf of the bidders.
Buyer’s premium is 18% and will be added to the hammer price. That premium includes the VAT under the Margin Scheme, not deductible for the purchasers.
All auction invoices should be paid within the 14 days period since auction ended. The Organizer has a law to cancel all orders staying unpaid after these terms or can start charging for statutory interest.
The authenticity of all auction’s items is guaranteed, unless otherwise stated in the description of the particular item.
Participation in the auction is subject to prior registration and acceptance of these terms and conditions.
The auction participant after the registration in auction is granted with the amount of credit for the auction and can bid items under this credit. After exceeding it the bidding will be locked for him.
The auction participant can ask for an increase his auction’s credit, but in this case the organizer can ask him for paying the deposit.
Lots viewing is available before the auction at the Organizer's office. All lots are sold as been viewed by buyers.
The items are knocked down after the highest bid has been called third time. The auction participant who has offered the knocked down price becomes the buyer of that item.
The auction is conducted in polish zlotych (PLN). The organizer accepts the payments of the equivalent PLN amount in EURO or USD.

The Organizer accepts cash payments up to the amounts of 10.000 € or its equal in other currencies.
Pick up or shipping the auction items:

Purchased items will be handed over to the buyer, or to the person authorized by him, upon receipt by the Organizer of the full amount due.
Domestic shipping (on the polish address) is free of charges for purchases over 3.000 PLN
Domestic shipping (on the polish address) for purchases below 3.000 PLN is the Buyer's cost. For packages with weight up to 1kg it is 20 zloty for insured shipping by Pocztex.
Worldwide shipping is calculated each time individually, on request.

Items with amounts over 16.000 PLN (~3.500€) can be taken outside of Poland only after receiving official permission for exportation. The procedure of exportation and receiving permissions is regulated by the act of lat from 23rd July 2003 entitled „On the protection and tutelage of National Monuments” with amendment from 18th March 2010.
Obtaining a permission for exportation is the buyer’s responsibility.
Only the Polish text of the terms of auction has a legal force. This free translation has been made only as a guidance.

Organizatorem aukcji jest Gabinet Numizmatyczny Damian Marciniak (GN Damian Marciniak), Al. Jerozolimskie 65/79, 00-697 Warszawa, NIP 831-147-96-58.
Aukcja odbywa się w imieniu licytujących, a na zlecenie i rachunek właścicieli przedmiotów, którzy pozostają anonimowi.
Opłata aukcyjna wynosi 18% i doliczana jest do wylicytowanej kwoty.
Zwycięzca licytacji jest zobowiązany do uregulowania należności w ciągu 14 dni od zakończenia licytacji. Po upływie tego terminu Organizator ma prawo anulować niepłacone zamówienia aukcyjne, bądź rozpocząć naliczanie odsetek ustawowych za zwłokę.
Autentyczność oferowanych przedmiotów jest gwarantowana przez Organizatora bezterminowo, chyba że w opisie danego przedmiotu zaznaczono inaczej.
Warunkiem uczestnictwa w aukcji jest wcześniejsza rejestracja, jednoznaczna z akceptacją niniejszego regulaminu.
Uczestnikowi aukcji przyznawany jest kredyt wydatków na aukcję, powyżej którego nie może On licytować.
Uczestnik aukcji może poprosić o zwiększenie kredytu wydatków, przy czym Organizator zastrzega sobie prawo uwarunkowania tej prośby wpłatą wadium.
Oglądanie przedmiotów aukcyjnych dostępne jest dla Uczestników aukcji, w siedzibie Organizatora, po uprzednim zaanonsowaniu wizyty.
Uczestnicy aukcji biorący udział w licytacji będą traktowani tak jakby oglądali przedmioty i studiowali ich stan zachowania.
Zakończenie licytacji następuje po trzykrotnym wywołania ceny i jej zatwierdzeniu (przybiciu), a zwycięzcą licytacji zostaje ten jej Uczestnik, który zaoferował zatwierdzoną cenę.
Walutą aukcji jest PLN i wartość wyrażona w tej walucie stanowi podstawę rozliczeń. Organizator akceptuje regulowanie równowartości należnej kwoty również w walutach EURO i USD.
Preferowaną przez Organizatora formą regulowania należności jest przelew bankowy na jeden z wskazanych poniżej numerów rachunku.

Alternatywne, akceptowane formy płatności to zapłata gotówkowa dostępna dla zamówień o równowartości poniżej 15.000 € oraz płatność PayPal przy powiększeniu należnej kwoty o 4% tytułem opłaty transakcyjnej serwisu PayPal.
Odbiór lub wysyłka przedmiotów:

Przedmioty zostaną przekazane zwycięzcy licytacji, lub osobie przez niego upoważnionej, po otrzymaniu przez Organizatora pełnej należności.
Wylicytowane przedmioty można odebrać z siedziby Organizatora, po wcześniejszym uzgodnieniu z Organizatorem szczegółów odbioru.
Koszty wysyłki krajowej zamówień aukcyjnych o wartości powyżej 3.000 zł pokrywa Organizator.
Koszty wysyłki krajowej zamówień aukcyjnych o wartości do 3.000 zł wynoszą 20 zł i pokrywa je nabywca. Wysyłka jest ubezpieczona i realizowana przez firmę kurierską Pocztex.
Koszty wysyłki zagranicznej pokrywa nabywca. Forma i koszt takiej wysyłki każdorazowo ustalany jest indywidualnie.

Przedmioty o wartości powyżej 16.000 PLN mogą być wywiezione poza granicę Polski tylko po uzyskaniu pozwolenia na wywóz.
Zasady wywozu i wydawania zezwoleń na wywóz reguluje ustawa z dnia 23.07.2003 „O ochronie zabytków i opiece nad zabytkami”, a w szczególności jej nowelizacja z dnia 18.03.2010r.
Obowiązek uzyskania stosownych pozwoleń wywozowych spoczywa na Zwycięzcy licytacji i Organizator nie pośredniczy w tej procedurze.
Niniejszy regulamin został sporządzony w języku polskim i opublikowany w tymże języku, jak i opublikowany w tłumaczeniu na języki obce, przy czym w kwestiach spornych moc prawną ma jedynie polski tekst regulaminu.
Miejscem rozstrzygania ewentualnych sporów jest właściwy dla Organizatora Sąd Rejonowy dla miasta st. Warszawy.
